Mutual Rights and Obligations


  • Definitions
    • "Provider" means 1. Web IT, ID: 24841633, Vinohradská 2279/164, Prague 3 – Vinohrady.
    • "Application" means the internet application LockNess, primarily designed for identity and access management, available at https://lockness.1webit.cz/login/.
    • "T&C" means these Terms and Conditions.
    • "Contract" means the agreement between the User and the Provider granting the User a license under these T&C.
    • "License" means a non-exclusive license to use the Application under these T&C.
    • "User" means any individual or legal entity other than the Provider using the Application.

  • Contract Conclusion Process
    • Signing the contract constitutes full acceptance and forms a binding agreement.
    • These T&C become effective upon contract conclusion.

  • Use of the Application
    • The Provider grants a License under the terms specified in the Application.
    • The User agrees to pay the specified fee for the License.
    • The Provider may delay access until payment is made; non-payment terminates the contract.
    • The User may not grant sublicenses.
    • Payments are considered made when received in the Provider’s bank account.
    • The Provider may suspend or disable the Application with notice for any reason; in such case, the User may receive a proportional refund.
    • Users are entitled to use the current version of the Application as per the Contract.
    • The User agrees to avoid causing damage to the Provider through use of the Application.

  • Database
    • The User may not extract data using bots or automation.
    • All User-entered data becomes part of the Provider’s database.
    • Application data is considered reliable under Czech Civil Code § 562(2).

  • Liability for Damages
    • This section does not apply to consumers.
    • The User waives claims for damages caused unintentionally or by non-gross negligence.

  • Data Protection

  • Mandatory Consumer Information
    • This section applies only to consumers.
    • The Provider informs that:

      • License fees include all taxes and charges.
      • License must be paid unless otherwise specified.
      • No delivery costs are charged.
      • Use requires internet access and a web browser.
      • No additional communication charges apply.
      • Contract data is stored in the Application.
      • Data entry errors can be corrected via the Application or support.
      • Only Czech laws apply; no codes of conduct are binding.
      • No out-of-court dispute resolution is used.
      • No goods are delivered; warranty rules do not apply. Defects must be claimed as per law and the contract.
      • Users must follow these T&C and Czech law.
      • Complaints can be filed with relevant supervisory bodies such as the Czech Trade Inspection Authority.

  • Governing Law
    • These T&C and the Contract are governed by Czech law, especially Civil Code No. 89/2012 Sb.
    • Disputes will be resolved by competent Czech courts.
